Welcome to pAInless! These Terms of Service ("Terms") govern your use of our website located at movepainless.com (the "Site") and your purchase of our personalized exercise plans (the "Service"). By accessing the Site or purchasing our Service, you agree to be bound by these Terms.
1. The Service: The "Founding Members" Program
pAInless currently operates a "Concierge MVP" model for its founding members. The Service consists of:
• A comprehensive questionnaire designed to gather information about your physical condition, lifestyle, and goals.
• A personal review of your questionnaire responses by our human expert ("Movement Science Specialist").
• The creation and delivery of a personalized 2-week exercise plan in PDF format, including links to video demonstrations.
• A one-time email check-in approximately one week after the delivery of your plan.
2. CRITICAL HEALTH DISCLAIMER: NOT MEDICAL ADVICE
You expressly agree and understand that pAInless is NOT a licensed medical care provider, and our Service does not constitute medical advice, diagnosis, or treatment. Our Service is an educational tool designed to provide exercise suggestions based on the information you provide.
• Always consult with a qualified, licensed physician or other healthcare provider before beginning any new exercise program.
• If you experience any sharp pain, dizziness, or shortness of breath during any exercise, stop immediately and consult a healthcare professional.
• Our Service is not a substitute for a professional medical evaluation. We do not diagnose or treat injuries or medical conditions.
3. Payments, Refunds, and Delivery
• PAYMENT: The Service is offered for a one-time payment of $39.00 USD. This fee is for the creation and delivery of one (1) 2-week personalized plan. This is not a subscription.
• REFUNDS: Due to the personalized and digital nature of our Service, all sales are final. Once our expert has begun the analysis of your questionnaire, we cannot offer a refund.
• DELIVERY: We will deliver your personalized plan to the email address you provide within 24-48 business hours after receiving your completed questionnaire and successful payment.
4. User Responsibilities
You agree to:
• Provide accurate, complete, and truthful information in the diagnostic questionnaire. The quality and safety of our plan depend entirely on the accuracy of your input.
• Use the Service for your personal, non-commercial use only. You may not resell, share, or distribute the plan provided to you.
• Be at least 18 years of age to use our Service.
5. Limitation of Liability
To the fullest extent permitted by law, pAInless, its founders, and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages, or any physical injury, resulting from your use of, or inability to use, the Service. You are performing all exercises at your own risk.
6. Intellectual Property
The content on the Site, and the content and structure of the plans delivered to you, are the intellectual property of pAInless and are protected by copyright laws.
7. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page.
